Please read these Terms of Use carefully before accessing or using any part of the Hifutai platform, available at hifutai.com. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
"Platform" refers to the Hifutai website, services, webinars, tools, and all associated content accessible at hifutai.com.
"User" refers to any individual who accesses, browses, registers on, or otherwise interacts with the Platform.
"Account" refers to a registered user profile created to access features of the Platform.
"Content" refers to all text, audio, video, materials, presentations, documents, and other information made available through the Platform.
"We," "Us," or "Our" refers to Hifutai and its operators.
2. Acceptance of Terms
By accessing the Platform in any manner, you enter into a legally binding agreement with Hifutai under these Terms of Use, together with our Privacy Policy and any additional guidelines or rules posted on the Platform. These Terms apply to all visitors, registered users, and others who interact with the Platform.
We reserve the right to update or modify these Terms at any time. The date of the most recent revision is indicated at the top of this page. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
3. Eligibility
You must be at least 16 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
4. User Accounts
4.1 Registration
Certain features of the Platform require you to create an Account. When registering, you agree to provide accurate, current, and complete information. You are responsible for keeping your account information up to date.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You agree to notify us immediately at contact@hifutai.com if you suspect any unauthorised access to your Account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.
4.3 Account Termination
We reserve the right to suspend or permanently terminate your Account at our sole discretion, without prior notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to other users or the Platform.
5. Permitted Use
You may use the Platform solely for lawful, personal, and non-commercial educational purposes, unless you have entered into a separate written agreement with Hifutai permitting commercial use.
You agree not to:
a. Copy, reproduce, distribute, or publicly display any Content without prior written permission from Hifutai;
b. Attempt to gain unauthorised access to any part of the Platform, its servers, or connected systems;
c. Use automated tools, bots, scrapers, or crawlers to extract data from the Platform;
d. Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
e. Upload, transmit, or distribute any malicious code, viruses, or harmful software;
f. Interfere with or disrupt the integrity or performance of the Platform or its infrastructure;
g. Engage in any conduct that is abusive, harassing, defamatory, or otherwise objectionable toward other users or staff;
h. Use the Platform for any unlawful purpose or in violation of any applicable regulations.
6. Intellectual Property
6.1 Ownership
All Content on the Platform, including but not limited to webinar recordings, presentations, graphics, logos, text, and software, is the exclusive property of Hifutai or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership rights in the Platform or its Content.
6.2 Limited Licence
Subject to your compliance with these Terms, Hifutai grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content for your personal, non-commercial educational purposes. This licence does not include the right to sublicense, sell, resell, reproduce, or create derivative works based on any Content.
6.3 User Submissions
If you submit any content to the Platform, including questions, comments, or feedback during webinars or through communication tools, you grant Hifutai a worldwide, royalty-free, perpetual licence to use, reproduce, and display such submissions in connection with operating and improving the Platform. You represent that you have all rights necessary to grant this licence.
7. Webinars and Live Sessions
7.1 Participation
You agree to participate in webinars and live sessions in a respectful and constructive manner. Disruptive behaviour, including but not limited to harassment, spamming, or sharing inappropriate content during sessions, may result in your removal from the session and suspension of your Account.
7.2 Recording
Webinars and live sessions may be recorded by Hifutai. By participating, you consent to being recorded in the capacity of an attendee. You may not record, capture, or redistribute any session without the express written consent of Hifutai.
7.3 Availability
Hifutai does not guarantee the uninterrupted availability of live sessions. Sessions may be rescheduled, cancelled, or modified due to technical issues, speaker unavailability, or other circumstances beyond our reasonable control.
8. Fees and Payments
Certain services or Content on the Platform may be offered for a fee. Where fees apply, the applicable pricing will be clearly disclosed prior to purchase. All fees are stated inclusive or exclusive of applicable taxes as indicated at the point of sale.
All payments are processed through third-party payment providers. Hifutai does not store your payment card details. By completing a purchase, you agree to the terms of the applicable payment processor.
Refund eligibility, where applicable, is governed by the specific terms presented at the time of purchase. Unless otherwise stated, all fees are non-refundable once access to the relevant Content or session has been granted.
9. Third-Party Links and Services
The Platform may contain links to third-party websites, tools, or services. These links are provided for convenience only. Hifutai does not endorse, control, or assume any responsibility for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to the terms of those services.
10. Disclaimers
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Hifutai does not warrant that the Platform will be error-free, uninterrupted, secure, or free of viruses or other harmful components.
Educational Content provided through the Platform is for informational purposes only and does not constitute professional, legal, financial, or regulatory advice. Users are solely responsible for how they apply information obtained through the Platform.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Hifutai and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Platform or its Content, even if advised of the possibility of such damages.
In no event shall Hifutai's total aggregate liability to you for any claims arising under these Terms exceed the amount you paid to Hifutai in the twelve months preceding the event giving rise to the claim, or fifty euros (€50), whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Hifutai and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
13. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
14. Modifications to the Platform
Hifutai reserves the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any service offered through it.
15. Governing Terms
These Terms constitute the entire agreement between you and Hifutai with respect to your use of the Platform and supersede all prior agreements, representations, and understandings relating to the same subject matter.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
